Wildlife Safari Kenya Limited (The Company referred to as Wildlife Safari) organizes safaris and travel arrangements in Africa. Please read the Terms and Conditions carefully as together they set out our respective obligations and form the basis of your contract with us. These terms are amended from time to time due to changing circumstances; the terms at the time of booking are terms that are valid.
Booking terms
Accuracy of information
The descriptions, information and opinions given by us in respect of national parks and game reserves, animal sightings, accommodation, itineraries and security are given in good faith, based on the latest information available to us. Every care has been taken to ensure the accuracy of the information provided. We cannot accept any responsibility or liability for any errors or omissions caused by matters beyond our control.
Booking and payments
Wildlife Safari requires a deposit of thirty percent (30%) of the total travel cost to confirm your travel arrangements with balance of payment due sixty (60) days prior to your departure date. Some suppliers may require additional deposits and this will be advised at time of reservation. Reservations will be cancelled if final payment is not received by the due date with full loss of deposit. Changes made within sixty (60) days of the departure date will be charged at the cancellation penalties outlined in the cancellations clause.
Acceptance
By confirming a booking, on payment of a deposit, you accept these terms and conditions.
Cancellations
All cancellations must be received in writing by Wildlife Safari and all cancellations will be charged a cancellation penalty based on the number of days prior to departure date:
Cancellations more than 60 days prior – no refund of deposit
Cancellations 60 days or less before travel – 100% of Travel arrangements
Some tour arrangements may incur additional cancellation penalties. Cancellation penalties on airfares are additional and are excluded from the above cancellation charges.
There is no refund for any unused portions of our safari once it is commenced.
Validity and changes
Quotations are valid for thirty (30) days from the date of quotation and all costs are based on known costs and rates of exchange at quotation date and significant changes beyond the control of Wildlife Safari will be passed on.
Accommodation and alteration to services
In the unlikely event that the accommodation/s proposed for your travel arrangement/s are not available, we reserve the right to substitute for comparable accommodation/s. Wildlife Safari reserves the right to alter any travel arrangements due to local conditions beyond our control.
Ground transportation
While every effort will be made to ensure that vehicles provided are in a roadworthy condition, Wildlife Safari will not accept any liability for breakdown, or any damage or delay. Our guides are instructed to follow our code of conduct, which you must not ask them to break in any way. You will be liable for legal costs including damage caused to a vehicle as a result of interference to the code of conduct. In the event a guide does not follow the code, please inform the transport manager in Nairobi. The vehicle/s shall be driven by the company’s driver/s and/or guide/s whose decision on all matters such as the route taken is final.
Airfares
All airfares, surcharges & ticketed taxes are current at the quotation date and may change without notice prior to ticketing. Wildlife Safari is not responsible for changes in airline schedules, airfares, surcharges, ticketed taxes, cancellations, frequent flyer program(s) conditions, damage or loss of any baggage and/or flight overbooking. All claims for any loss or injury suffered on any airline must be made directly with the airline involved. The sole and exclusive responsibility and liability of any participating airline shall be in accordance with and as limited by the contract of carriage in the passenger’s ticket, the applicable tariffs and the provisions of the Warsaw Convention. The airlines are not responsible or liable for any act, omission or occurrence during the time passengers are not on board their aircraft. Wildlife Safari and/or its Independent contractors do not act on behalf of the airlines and they do not have a direct business association or relationship with the airlines and only provide the travel arrangements other than air transportation.
Insurance
In order for us to make travel arrangements you must have, appropriate insurance for the type of holiday being taken with us. Such insurance should fully cover death, personal injury, medical expenses, repatriation in the event of accident or illness or death, cancellation or curtailment of the holiday by side and loss of, damage to, or theft of the clients’ personal property. Activities with a greater inherent risk, such as mountaineering, animal tracking on foot, white-water rafting should also be covered.
Complaints
All complaints must be sent in writing to Wildlife Safari by the passenger within fourteen (14) days of the alleged event/s or incident/s resulting in the complaint/s.
Statement of responsibility
Wildlife Safari acts as an agent for the traveller with respect to services provided, including, but not limited to, accommodations and meals in hotels, resorts, lodges, camps and restaurants, as well as all transportation and activities. All services are provided by suppliers who are independently owned and operated and are not controlled by Wildlife Safari. Wildlife Safari takes all precautions with the selection of various suppliers but is not responsible or liable for any loss or damage incurred by the traveller and caused by any independent supplier.
Wildlife Safari takes all reasonable precautions to make our travel arrangements as secure and as reasonable as possible for all passengers and others. Wildlife Safari Kenya Ltd and its agents shall not be responsible or liable for any injury, loss, damage, delay or inconvenience arising out of, or in connection with, any defect in any vehicle or any act, including any acts of terrorism, industrial action, government directives, war, civil disturbances, acts of God, neglect, accident, error or omission for the provision of any travel arrangements.
All travel involves possible personal risk that travellers must determine. Wildlife Safari suggests consulting the Department of Foreign Affairs and Trade for their travel advisories.
Wildlife Safari retains the right to accept or decline any person from joining or continuing any travel arrangements for any reason or if the person causes or is deemed to cause any hazard, damage or inconvenience to him/her, third parties, staff, flora, fauna or property.
Jurisdication
Wildlife Safari is incorporated in the Republic of Kenya and it operates under the laws and jurisdiction of Kenya. Your contract with us and matters arising out of it will be governed by the laws and jurisdiction of Kenya. Contracts made with our associated company/ies outside Kenya will be governed by their respective laws.
